Condemnation
Most governmental bodies and a few private entities have what is called the power of eminent domain. Through the exercise of this power, these entities can acquire privately owned property when it is needed (and used) for public purposes. The process of exercising this power and acquiring privately owned property is also known as condemnation.
There are strict procedures which must be followed when acquiring private property including public hearings, advance notice to landowners, and good faith negotiations.
The law requires that if land is acquired from a private owner, the owner must be paid just compensation. Unfortunately, the entity and the owner often have very different opinions on what amount of compensation is just. Should the parties not agree upon the amount of compensation, every property owner in Nebraska has the right to have a jury determine the amount of compensation paid to them as a result of the taking of their property.
